..Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the 6th Respondent (Sub- Registrar, Chetpet) to cancel Partition Deed registered as Document No. 1249 / 2024 dated 28.03.2024 in view of the cancellation of the base Legal Heir Certificate by the 5th Respondent vide proceedings Roc. No.A3/2012/2025 dated 19.09.2025 issued pursuant to the orders of this Hon’ble Court in W.P.

No.13964 of 2025.

ORDER

Asserting that partition deed dated 28.03.2024 bearing document no.1249/2024 was registered on the basis of an invalid legal heir certificate, the petitioner seeks cancellation thereof.

2. Learned counsel for the petitioner relies on the order issued by the jurisdictional tahsildar in September 2025 cancelling the legal heir certificate. In view thereof, he submits that the registration of the partition deed is liable to be cancelled.

3. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for all the respondents.

4. The petitioner has not joined the parties to the partition deed as respondents in this writ petition. Even otherwise, it is necessary to adjudicate on disputed questions of fact to decide whether the partition deed was executed solely on the basis of the legal heir certificate. Therefore, the appropriate remedy for the petitioner is to approach the jurisdictional civil court on the strength of the cancellation of the legal heir certificate. By leaving it open to the petitioner to do so, this writ petition stands disposed of without any order as to costs.
