ORDER

Mr. M. Sekar, learned counsel accepts notice on behalf of R1 and R3. Mr.

B. Anandakumar, learned counsel accepts notice on behalf of R2.

2. This writ petition has been filed to direct the respondents 2 and 3 not to establish a TASMAC Shop and BAR at the premises morefully described in the prayer to this writ petition.

3. The petitioner claims that since the proposed TASMAC Shop at the premises morefully described in the prayer to this writ petition is within 500 meters from the National Highway, the said TASMAC Shop and BAR cannot be established.

4. The petitioner is a neighbouring land owner. He has given a representation on 06.01.2026 to the respondents, requesting them not to establish a TASMAC Shop and BAR in the premises morefully described in the prayer to this writ petition. Since the said representation has not been considered till date, this writ petition has been filed.

5. No prejudice would be caused to the respondents if the petitioner’s representation as stated supra is considered on merits and in accordance with law after hearing the objections of the necessary parties including the landlord of the property as well as the lease holder of the BAR as well as any other third party whom the second respondent deems it fit to enquire within a time frame to be fixed by this Court.

6. This Court is not expressing any opinion on the merits of the petitioner’s representation dated 06.01.2026.

7. For the foregoing reasons, this Court directs the second respondent to pass final orders on merits and in accordance with law on the petitioner’s representation dated 06.01.2026, requesting the second respondent not to establish a TASMAC Shop and BAR at the premises morefully described in the prayer to this writ petition within a period of twelve weeks from the date of receipt of a copy of this order after hearing the objections of the necessary parties including the landlord of the property as well as the lease holder of the BAR as well as any other third party whom the second respondent deems it fit to enquire after giving due consideration to the documents filed along with the petitioner’s representation.

8. Accordingly, this writ petition is disposed of. No Costs.
