The present Writ Petition has been filed directing the respondents 3, 5 and 6 to remove the encroachments made by the 7th respondent in the Road named Muthur to Karasamadai Village Road.
2. At this juncture, the learned Special Government Pleader appearing on behalf of the respondents, on written instructions given by the Tahsildar, Palladam, would submit that they have already issued notice under Section 6 of the Tamil Nadu Land Encroachment Act, 1905 [hereinafter referred to as “the Act”]. In pursuance thereof, the encroacher/
7th respondent has already preferred an appeal before the District Collector under Section 10 of the Act.
3. In view of the same, we do not find any merit to entertain the present Writ Petition and we also direct the Authorities to remove the encroachments, if any, found after disposal of the appeal under Section 10 of the Act.
4. With the above directions, this Writ Petition is disposed of. No costs.
