PRAYER: Writ petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Certiorarified Mandamus, to quashing the 1st respondent order in Na.Ka. No.227/ 2024 dated 04.11.2024 as unconstitutional and to further direct the 1st respondent to register and release the sale deed in respect of S.No.191/8 measuring 6.32 cents at Tirupur Taluk and District.

ORDER
Intending to purchase property measuring 6.32 cents in Survey No.191 of 8, a sale deed was executed in favour of the petitioner on 28.06.2024. When presented for registration, the request for registration was refused under impugned order dated 04.11.2024.
2. Learned counsel for the petitioner submits that the first respondent erroneously concluded that it is the property of the second respondent.
3. Learned counsel for the second respondent submits that a service inam was granted earlier and the same was revoked for breach of conditions. Learned Special Government Pleader submits that the order was issued under Section 71 of the Registration Act and that an appeal lies under Section 72 thereof.
4. On perusal of the impugned order, it is evident that it is a speaking order under Section 71 of the Registration Act, 1908. An appeal lies therefrom under Section 72 before the District Registrar. Considering the ground of refusal, namely, that the property is owned by the second respondent, the appropriate remedy for the petitioner is to approach the District Registrar by way of appeal under Section 72. By leaving it open to the petitioner to file an appeal under Section 72, this writ petition is disposed of. Since the petitioner filed this writ petition in October 2025 and prosecuted the same diligently and bona-fide, if the appeal were to be filed within thirty days from the date of receipt of a copy of this order, the Appellate Authority is directed to receive and dispose of the same on merits without going into the limitation period. No costs.
Consequently, the connected writ miscellaneous petition is closed.
