This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to consider the petitioner’s representation dated 02.01.2023 and to fix fair compensation and to pay adequate compensation for the land in Survey No.613/17C, measuring about 370 sq.m., at Kottaram East Village, Agasteeswaram Taluk, Kanyakumari District acquired from the petitioner in proceedings Na.Ka.No.23/20945/2021 dated 30.08.202 by following the guidelines contained in the Government Circulars issued from time to time and G.O.
(Ms) No.281 dated 07.09.2017.
2. The grievance of the petitioner is that the petitioner’s land was acquired and the document was duly registered. However, 1/3rd of the compensation amount was deducted. The petitioner was not aware of such deduction. Hence, this Writ Petition has been filed.
3. The learned Government Advocate appearing for the respondents would submit that a private negotiation was held with the petitioner and that after the petitioner gave written consent for deduction of one-third of the compensation amount, the land was registered in the name of Railway Department.
4. At this juncture, the learned counsel for the petitioner would submit that the petitioner would invoke the jurisdiction of the Civil Court.
5. Recording the said submission, this Writ Petition is disposed of.
No costs.
