O R D E R
The present writ petition has been filed seeking a direction to the respondent to consider the petitioner's representation dated 19.11.2025.
2. It is the case of the petitioner that he is the duly elected Chairman of the Indian Red Cross Society. He was last elected on 13.05.2023 by the members in accordance with the provisions of the Red Cross Societies Act and the Rules in force. As per the Act and the Rules, the tenure of the Chairman is three years. Accordingly, his tenure is valid from 2023 to 2026 and is still subsisting. However, before the expiry of his tenure, certain members convened a meeting on 15.11.2025 and, with the support of a few others, conducted an election in an illegal manner and elected a new Chairman and Vice-Chairman. Prior to this, a communication dated 20.09.2025 had been circulated by the District Branch directing all branches of the Red Cross Society to conduct elections on or before 31.10.2025. The petitioner objected to the said circular on the ground that his tenure had not yet expired and that conducting an election before the completion of his tenure is illegal and contrary to the Act and the Rules in force. In this regard, the petitioner submitted a representation dated 19.11.2025 to the respondent seeking appropriate action against the officials of the Poodhaloor Branch of the Red Cross Society. However, no action has been taken by the respondent till date. Hence, the present writ petition.
3. The learned Additional Government Pleader appearing for respondent would submit that the petitioner’s representation would be considered in accordance with law.
4. This Court, without expressing any opinion on the merits of the matter, directs the respondent to consider and dispose of the petitioner's representation dated 19.11.2025, on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order.
5. Accordingly, the writ petition stands disposed of. No costs.
