O R D E R

The present writ petition has been filed seeking a direction to the second and third respondents to refund the deposit amount of Rs.5,00,000/- to the petitioner based on the petitioner's representation

16.12.2025 within a stipulated time in accordance with law.

2. It is the case of the petitioner that he applied to the third respondent seeking permission to set up a giant wheel during the temple festival. As per the instructions of the Temple authorities, bidders were required to pay a sum of Rs.5,00,000/- as a deposit. Accordingly, the petitioner paid a sum of Rs.5,00,000/- through online transfer in favour of the third respondent on 14.05.2025 at the time of submission of tender. Thereafter, the petitioner was declared the successful bidder and was allotted the tender for installation of the giant wheel at his competitive bid amount of Rs.62,26,000/-, which he accepted. The petitioner submits that, after accepting the tender amount, the third respondent and the President of the Temple Trust Committee instructed him to install the giant wheel in the vacant space in and around the temple premises. However, the petitioner could not install the giant wheel as there was no sufficient space available around the temple for such installation. Therefore, the petitioner requested the third respondent to refund the deposit amount. In this regard, he submitted a representation to the respondents on 16.12.2025. However, the respondents have neither refunded the amount nor taken any action on the petitioner’s representation. Hence, the present writ petition.

3. The learned Special Government Pleader appearing for the respondents would submit that the petitioner’s representation would be considered in accordance with law.

4. This Court, without expressing any opinion on the merits of the matter, directs the third respondent to consider and dispose of the petitioner's representation dated 16.12.2025, on merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.

5. Accordingly, the writ petition stands disposed of. No costs.
