O R D E R

The petitioner, who served as a District Registrar in the Registration Department retired from service on attaining the age of superannuation on 30.11.2013. He has submitted a representation on 14.02.2022 that he is entitled for promotion as an Assistant Inspector General of Registration with effect from 27.09.2013. However, the same has not been considered by the respondents. Therefore, the petitioner has filed a writ petition before this Court in WP(MD) No.5928 of 2022, seeking a direction to the respondents to promote him notionally to the post of Assistant Inspector General of Registration with effect from 27.09.2013, by considering his representation dated 14.02.2022. This Court, by its order, dated 21.10.2024 has disposed of that writ petition, by issuing a direction to the Secretary, Commercial Taxes and Registration Department to consider the representation of this petitioner, dated 14.02.2022 and pass suitable orders. Accordingly, the representation of the petitioner was considered by the Secretary and it was rejected vide Letter No. 44/H2/2025-2, dated 21.03.2025. Now the petitioner has filed this writ petition that his right of promotion has been denied and seeks a direction to the respondents to grant the consequential retirement and monetary benefits in the promotional post.

3.The request of the petitioner for notional promotion as Assistant Inspector General of Registration has been rejected by the Secretary, Commercial Taxes and Registration Department in letter No.44/H2/2025-2, dated 21.03.2025. Without challenging the rejection order, the petitioner has moved this writ petition for a Mandamus, directing the respondents to grant the retirement and monetary benefits, by giving him notional promotion as Assistant Inspector General of Registration with effect from 27.09.2013.

4.Since the relief sought for in this writ petition has already been considered by this Court in earlier occasion in WP(MD) No.5928 of 2022, dated 21.10.2024 and directions were issued to the respondents to consider the petitioner’s representation and as such the petitioner's representation was considered and rejected vide letter No.44/H2/2025-2, dated 21.03.2025, this Court is not inclined to entertain this writ petition.

5. Accordingly, this writ petition is dismissed. However, liberty is granted to this petitioner to challenge the order dated

21.03.2025 in the manner known to law. No costs.
