O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first to third respondents to consider the petitioner’s representation dated 29.01.2026 and issue patta in S.F.No. 10/2, Kannakur Village, Avudaiyarkoil Taluk, Pudukkottai District within a time to be stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

The grievance of the petitioner is that he is the absolute cultivator and possessor of 1 acre of agricultural land in S.F.No.10/2, Kannakur Village, Avudaiyarkoil Taluk, Pudukkottai District, which he inherited from his ancestors, who have cultivated paddy therein since time immemorial. The land, bounded on the east and north by his patta lands and on the west by a tar road, has been continuously cultivated and has never been treated as a water body. However, it has been wrongly classified in the revenue records as “Sarkar Poramboke Neerpidi”, while adjoining similarly classified lands were granted patta.

Though the Revenue Department surveyed the area and installed boundary stones clearly demarcating the Kannakur Small Lake and the petitioner’s land lies outside such boundary, the fourth respondent issued eviction notices dated 07.01.2026 and 19.01.2026 without jurisdiction. The said action is arbitrary, illegal and violative of Article 300A of the Constitution of India, as no person can be deprived of his property except by authority of law. The petitioner submitted a representation dated 29.01.2026 seeking issuance of patta in his name. However, the same has not been considered. Hence, the present Writ Petition has been filed. 5. The learned Special Government Pleader appearing for the respondents, on instructions, would submit that the petitioner's representation would be considered and appropriate orders would be passed by the second and third respondents within a period of twelve weeks.

Recording the above submissions and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second and third respondents to consider the petitioner’s representation dated 29.01.2026 and pass orders on merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order. The second and third respondents shall conduct an enquiry and afford a reasonable opportunity of hearing to the petitioner and all other interested parties before passing orders. If, upon such enquiry, the petitioner is found entitled to patta, the same shall be issued in his name forthwith. No costs. Consequently, the connected Miscellaneous Petition is closed.
