ORDER

This Writ Petition has been filed to direct the respondents to consider the petitioner’s representation, dated 08.09.2025, on merits and in accordance with law, within a time frame to be fixed by this Court.

2. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents.

3. The aforesaid representation was given by the petitioner seeking for issuance of patta in her name for the property morefully disclosed in the affidavit filed in support of this writ petition.

4. However, it is submitted by the learned Government Advocate appearing for the respondents that patta has already been issued in favour of a third party for the subject property and therefore, the petitioner must seek for cancellation of the said patta instead of seeking for issuance of patta in her name. Since the representation, dated 08.09.2025 seeks for issuance of patta in the name of the petitioner, necessarily, the petitioner will have to give a fresh representation to the 3rd respondent seeking for cancellation of patta standing in the name of the third party for the property disclosed in the affidavit filed in support of this writ petition.

5. The learned counsel for the petitioner, on instructions, would submit that the petitioner is willing to submit a fresh representation/appeal to the 3rd respondent seeking for cancellation of patta standing in the name of S.Enoc, S/o.Sigamani for the subject property.

6. No prejudice would be caused to the respondents, if a direction is issued to the 3rd respondent to dispose of the said representation on merits and in accordance with law, within a time frame to be fixed by this Court, after hearing the objections, if any, from the said S.Enoc, the neighbouring land owners as well as any third party as they deem fit.

7. This Court is not expressing any opinion on the merits of the petitioner’s representation.

8. For the foregoing reasons, this Court directs the petitioner to submit a fresh representation to the 3rd respondent seeking for cancellation of patta standing in the name of S.Enoc, S/o.Sigamani and for issuance of patta in his name thereafter, for the property morefully disclosed in the affidavit filed in support of this writ petition, within a period of two (2) weeks from the date of receipt of a copy of this order. On receipt of the said online representation/appeal within the stipulated time from the petitioner, the 3rd respondent shall pass final orders, on merits and in accordance with law, after giving due consideration to the supporting documents filed by the petitioner and after hearing the objections, if any, from the said S.Enoc, S/o.Sigamani, the neighbouring land owners as well as any other third party, whom the 3rd respondent deems it fit to enquire, within a period of twelve (12) weeks thereafter.

9. With the aforesaid directions, this Writ Petition is disposed of.

No costs.
