ORDER

The present writ petition has been filed seeking to quash the order passed by the first respondent Bank wherein the petitioner was informed that the gold jewels could be auctioned in case of non-payment of the loan amount.

2. Pending writ petition, by way of interim order, the petitioner has deposited the entire loan amount and as on today, there are no dues towards the said loan amount.

3. The learned Counsel appearing for the respondents submits that the jewels were pledged by the daughter-in-law by the petitioner. She has passed away. The son of the petitioner has also passed away. The grand children are in the custody of the writ petitioner. Therefore, unless guardian is appointed by the Court, jewels cannot be released in favour of the petitioner.

4. The learned Counsel appearing for the writ petitioner submits that he is ready to get no objection from the parents of Mrs.Bothesh Thiyagarajan, who is the daughter-in-law of the writ petitioner.

5. In case if all the parties reach consensus, the respondents are directed to release the jewels in favour of the writ petitioner.

6. With the above said observations, this writ petition stands disposed of.

No costs. Consequently, connected writ miscellaneous petition is also closed.
