O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to dispose of the petitioner’s petition in Na.Ka.No.Aa.3859/2025 within the time stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the third and fourth respondents, as no adverse orders are proposed to be passed against them.

3.The grievance of the petitioner is that the property in Survey No.

115/1, measuring an extent of 3 Acres and 50 Cents, situated at M. Pudhukulam Village, Thiruchulli Taluk, Virudhunagar District, belongs to the petitioner, who inherited the same by way of succession. The third and fourth respondents, who are adjacent landowners, have wrongfully encroached upon portions of the petitioner’s land and obtained Patta No.

826 in their favour in respect of the said property. Therefore, the petitioner filed a petition before the first respondent seeking cancellation of the said patta and restoration of patta in the name of the petitioner’s father as per the SLR. Except for numbering the petition as Na.Ka.No.Aa. 3859/2025, no action has been taken. Hence, the petitioner has been constrained to file the present Writ Petition.

4. The learned Government Advocate appearing for the first and second respondents, on instructions, would submit that the petitioner's petition would be disposed of by the first respondent within a period of twelve weeks.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to dispose of the petitioner’s petition in Na.Ka.No.Aa.3859/2025 on merits and in accordance with law, after conducting an enquiry, within a period of twelve weeks from the date of receipt of a copy of this order. The first respondent shall afford a reasonable opportunity of hearing to the petitioner, the private respondents and all other interested parties before passing orders. In the event of any rival claims, the parties are at liberty to work out their remedies before the competent Civil Court. No costs.
