O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to take appropriate action against the third respondent under Section 20(1) of the Right to Information Act, 2005, within a time frame to be stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The grievance of the petitioner is that as the second and third respondents failed to furnish the information sought by the petitioner under the Right to Information Act, 2005, the petitioner approached the first respondent-Commission by filing the second appeal. The first respondent conducted an enquiry and directed the third respondent to explain as to why action should not be initiated against him under Section 20(1) of the Act and also directed him to furnish the information to the petitioner. However, the third respondent has not furnished the information. The second appeal filed by the petitioner before the first respondent is also pending.

4. The learned Standing Counsel appearing for the first respondent, on instructions, would submit that the petitioner's second appeal would be disposed of by the first respondent within a period of eight weeks.

5. Recording the above submissions and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to dispose of the second appeal in SA/1692/E/2023 on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. The first respondent shall afford a reasonable opportunity of hearing to the petitioner and all other interested parties before passing orders. No costs.
