O R D E R

In this Writ Petition, the petitioner has challenged the impugned order dated 12.01.2026 passed by the second respondent, on the petition filed by the fourth respondent, cancelling the patta standing in the petitioner’s name.

2. The mutation was effected on 06.12.2025 pursuant to the petitioner’s purchase of the property on 08.11.2023. However, by the impugned proceedings dated 12.01.2026, the second respondent cancelled the patta standing in the petitioner’s name and directed the third respondent to restore the patta in the names of the petitioner’s vendors.

3. In the impugned order, it has been stated that a civil suit in O.S.No.55 of 2023 is pending on the file of the District Munsif Court, Thirumangalam.

4. Admittedly, the petitioner was not put on notice before the patta standing in his name was cancelled by the impugned order. The impugned order does not disclose that any notice was issued to the petitioner prior to the cancellation of the patta and the restoration of the revenue records in the names of the petitioner’s vendors, which is also not disputed by the learned Special Government Pleader appearing for the first to third respondents. Since issuance of notice is mandatory before effecting any change in the patta under Section 10(3) of the Tamil Nadu Patta Pass Book Act, 1983 and the second respondent failed to do so before passing the impugned order, the impugned order is liable to be set aside.

Accordingly, the impugned order is set aside.

5. Accordingly, this Writ Petition is disposed of. No costs.

Consequently, the connected Miscellaneous Petition is closed.
