PRAYER : Writ Petition filed under Article 226 of Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned legal heirship certificate issued by the 2nd respondent dated 04.12.2025 in Certificate No.TN-720251125838 and to quash the same, consequently direct the 2nd respondent to issue a fresh legal heirship certificate of deceased Rajeshwari, who died on 19.09.2025, by including the petitioners name as Class-II Legal Heirs within a stipulated time and pass orders.

ORDER

The writ petition has been filed seeking to quash the impugned proceedings of the second respondent dated 04.12.2025 and consequently to direct the 2nd respondent to include the name of the petitioner as Class-II Legal Heirs of deceased Rajeswari and to issue a fresh legal heir certificate.

2. When the matter is taken up for hearing, Mr.R.Neelakandan, learned Additional Advocate General appearing for respondents 1 and 2, has produced the proceedings of the Tahsildar, Gummidipoondi, dated 07.01.2026, who on instructions would submit, in the light of G.O.(Ms) No.110 dated 13.03.2024, the prayer sought in the writ petition cannot be granted, however, if aggrieved, the petitioner shall approach the Sub Registrar, Ponneri, the appellate Authority.

3. The learned counsel appearing for the petitioner seeks leave of this Court to withdraw this petition with liberty to file an appeal before the Appellate Authority. He has also made an endorsement to this effect in the case bundle.

4. Recording the submissions of the learned counsel and the endorsement so made by the learned counsel for the petitioner, this writ petition is dismissed as withdrawn. No costs. Consequently, connected miscellaneous petitions are closed.
