Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records relating to the order of the 2nd respondent dated 27.03.2025 in Na.Ka.No.2278/2025/Aa1 and quash the same and consequently directed the respondents to appoint the petitioner as hereditary Trustee of Nacharammal Trust, Vandiyur, Madurai forthwith.

O R D E R

When the matter was taken up for hearing, the learned counsel appearing for the petitioner submitted that although the petitioner had filed this Writ Petition challenging the appointment of a Fit Person, the petitioner’s brother had already filed a Revision Petition in R.P.No.561 of 2025 under Section 21 of the HR & CE Act before the Commissioner challenging the same appointment, and the said petition is pending. Therefore, the learned counsel for the petitioner seeks leave of this Court to agitate all the issues raised in this Writ Petition before the Commissioner in the pending Revision Petition filed by the petitioner’s brother.

2. In view of the above, this Writ Petition is dismissed granting liberty to the petitioner to agitate all the issues raised in this Writ Petition before the Commissioner, where R.P.No.561 of 2025 is pending. In the event, if any impleading application is filed by the petitioner in the pending R.P.No.561 of 2025, the Commissioner shall take the same on file and permit the petitioner to raise all the issues. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
