Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus by calling the records relating to the proceedings of the Respondent made in Na.Ka.No.8966/Aa3/2025/dated 12.08.2025 and quash the same and consequently direct the Respondent to accept the change of Members of the Society submitted in Form VI and VII, by the Petitioner Association in respect of the society bearing Registration No. 44 of 1967.

O R D E R

The present writ petition has been filed challenging the order passed by the second respondent, whereby the request of the petitioner for acceptance of Form VI and Form VII was rejected by proceedings dated 12.08.2025.

2. The learned counsel appearing for the petitioner submitted that 33 members of the petitioner Society were removed, and such removal was confirmed by this Court in W.P.(MD).No.9453 of 2024. This Court further directed the conduct of a General Body Meeting, excluding the said members and in the presence of the remaining 9 members. Pursuant thereto, a General Body Meeting was conducted and office bearers were elected.

3. The Form VII submitted by the petitioner Society was accepted by the Registrar on 03.12.2024.

4. The order of the writ Court was challenged in W.A.(MD).Nos.244 of

2025 and 2386 of 2024, and the writ appeals were dismissed by this Court on

23.04.2025, thereby confirming the order of the writ Court. Thereafter, the duly elected office bearers convened a meeting and passed resolutions on 12.09.2025 to induct new members and remove certain members. Since the password of the petitioner Society was blocked, the resolutions were forwarded through registered post to the respondent for being taken on file. However, the said request was rejected under the impugned order on the premise that the writ appeal was pending. Hence, the present writ petition.

5. The narration of the aforesaid facts clearly indicate that, as on date, no litigation is pending before any Court. The duly elected office bearers, whose Form VII has already been accepted by the Registrar, have resolved to induct new members and remove certain members. Therefore, the Forms VI and VII submitted by them ought to be considered by the respondent. In such circumstances, the impugned order is not sustainable and the same is set aside. The matter is remitted back to the file of the respondent, who is directed to receive the Forms VI and VII submitted by the petitioner Society and pass appropriate orders within a period of four (4) weeks from the date of receipt of a copy of this order.

6. With the above said directions, this writ petition stands disposed of.

No costs. Consequently, the connected miscellaneous petitions are closed.
