PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus (i) directing the 1st Respondent to reject the illegal amended byelaws of the 2nd respondent Association as requested by the petitioners under their representation dated 15.07.2025; (ii) to cancel the election held on 09.11.2025 on the basis on the said illegal amended bye-laws and to direct the holding of fresh elections strictly in accordance with the original bye-laws within a time to be fixed by this Hon’ble court and any appropriate writ, order or direction in the nature of writ.

ORDER
This writ petition has been filed for the reliefs which are as follows: (i)
directing the 1st Respondent to reject the illegally amended byelaws of the 2nd respondent Association as requested by the petitioners under their representation dated 15.07.2025; (ii) to cancel the election held on 09.11.2025 on the basis on the said illegal amended bye-laws and to direct the holding of fresh elections strictly in accordance with the original bye-laws.
2. It is the case of the petitioner that he is a registered owner of a residential apartment and a bona fide member of the second respondent. It is the further case of the petitioner that an amendment committee was constituted by the second respondent, in which, non-owners were unlawfully included. Despite rejections raised by several members of the second respondent, amended bye-
laws were filed with the first respondent.

Therefore, challenging the illegal amendment of the bye-laws of second respondent and the consequential election conducted based on such illegal amendment, the petitioner had submitted a detailed representation dated 15.07.2025 to the first respondent seeking inquiry and cancellation of the illegal amendment of the second respondent. Since the first respondent has not taken any action against the second respondent, the petitioner is before this Court.

Considering the above facts, this Court directs the first respondent to consider the petitioner’s representation dated 15.07.2025, on merits and in accordance with law and to pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order. Till such time, as the first respondent passes orders on the petitioner’s representation after issuing notice to the parties concerned and hearing them, the persons holding office prior to the disputed election shall continue as office bearers only for a limited purpose of receiving the maintenance amounts and disbursing the same for various day to day activities. It is made clear that no major decision shall be taken by these office bearers and neither permitted to hold any meetings.
With the above directions passed with consent of either party, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions stand closed.
