Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent to grant new electricity connection along with separate meter in the name of the landlords/respondents 3 to 5 on the petitioner paying necessary charges to the Department in respect of the premises situated in upstairs II Floor measuring to an extent of 15'X25' at Door No.60, Palakkarai Main Road, Tiruchirapalli Town.

O R D E R

The present writ petition has been filed seeking a Mandamus directing the respondents to restore the electricity service connection along with separate meter in the name of the landlords of the petitioner paying necessary charges to the Department in respect of the premises situated in upstairs II Floor measuring to an extent of 15'X25' at Door No.60, Palakkarai Main Road, Tiruchirapalli Town.

2. From the records it could be seen that the service connection of the writ petitioner has been disconnected in the year 2018 due to non payment of current consumption charges. A counter has been filed by the respondent Electricity Board stating as follows:

9. I respectfully submit that the petitioner is lease and there is a dispute between the third respondent (the present owner) and petitioner. The third respondent is objecting to granting of electricity connection stating that she is the owner of the building and the property was allotted to her share. Since there is a dispute between the landlord and tenant, moreover the service connection was dismantled, the petitioner would be entitled to the service connection as a new connection in the name of the petitioner as per Regulation 27(4) of Tamil Nadu Electricity Distribution Code, 2004. The petitioner ought to submit an application along with Indemnity Bond and pay twice the security deposit. However, it is submitted that the petitioner is seeking same relief before civil suit as well as present writ petition and the civil suit is still pending.

3. It could be seen from the records that there is a landlord and tenant dispute between the petitioner and the respondents 3 to 5 herein. The landlords were successful before the Rent Control Court in getting an order of eviction. The said eviction order has been challenged by the tenant and the same is pending before the appellate authority.

4. In such circumstances, if the petitioner submits an application along with indemnity bond and pays twice the security deposit, the respondents 1 and 2 shall restore the electricity service connection to the writ petitioner. The said exercise shall be completed within a period of two weeks. Any restoration of service connection will not affect the rights of the private respondents.

5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous petition is closed.
