ORDER

The present Civil Revision Petition has been filed challenging the order passed by the learned Rent Control Appellate Authority (Principal Subordinate Court), Tirunelveli, in I.A.No.1 of 2020 in R.C.A.No.12 of 2019, dated

07.11.2022.

2.Heard Ms.Murugeswari, learned Counsel representing Mr.T.Selvan, learned Counsel for the Revision Petitioners, Ms.E.RJ.Muthulakshmi, learned Counsel for the respondents 1 and 3 to 6 and Mr.S.Kumar, learned Counsel for the second respondent.

3.The respondents, one Banu Kareem and Y.Syed Yusuf are the landlords and one S.S.Sudalaiyandi is the tenant. The first petitioners herein is the legal heir of the deceased S.S.Sudalaiyandi. The respondents have filed a petition in R.C.O.P.No.12 of 2019 before the Rent Controller, Tirunelveli. The learned Rent Controller, Tirunelveli, vide impugned order, dated 13.06.2018, had passed an order of eviction. Challenging the same, an appeal in R.C.A.No.12 of 2019 was filed before the Rent Control Appellate Authority (Principal Subordinate Court), Tirunelveli. During the pendency of the proceedings, the respondents herein have filed an interlocutory application in I.A.No.1 of 2019 seeking a direction to the petitioners herein to pay or deposit the arrears of Rs.2,32,680/- due from 01.10.2012 upto 30.09.2018 for 84 months before the Rent Control Appellate Authority. The learned Rent Control Appellate Authority (Principal Subordinate Court), Tirunelveli, vide impugned order, dated 07.11.2022, had allowed the said application. Challenging the same, the present Civil Revision Petition has been filed.

4.Today, when the matter is taken up for hearing, the learned Counsel for the petitioners submitted that admittedly, there is an arrear of rent to the tune of Rs.2,38,680/- and further submitted that they already deposited a sum of Rs.1,25,000/- towards arrears of rent and they are willing to deposit the balance amount within a time limit stipulated by this Court.

5.Considering the submissions made by the learned Counsel for the petitioner, without going into the merits of the case, this Civil Revision Petition is disposed of with a direction to the petitioners to pay the entire balance amount of arrears within a period of four weeks from the date of receipt of a copy of this order.

6.In the result, the Civil Revision Petition is disposed of. No costs.

Consequently, connected miscellaneous petition is closed.
