Writ petition is filed under Article 226 of the Constitution of India seeking for issuance of a writ of mandamus to direct the respondents to hand over peaceful and vacant possession of Assigned Land to the petitioners herein based on their Assignment order Form-F dated 16.05.1988 and Representation dated 15.6.2023, 23.8.2023 and 23.8.2024 within the stipulated time as prescribed by this court.

ORDER
This writ petition has been filed seeking for a direction to the respondents to handover peaceful and vacant possession of the assigned land in favour of the petitioners.
2. However, as seen from the counter affidavit filed by the seventh respondent, the assignment issued in favour of the petitioners was already cancelled in the year 2000 itself.
3. The learned counsel for the petitioners submits that the petitioners were not served with the cancellation proceedings of the respondents cancelling the assignment issued in their favour.
4. Necessarily, the petitioners, if aggrieved by the cancellation of assignment issued in their favour, will have to challenge the same in the manner known to them under law. Since the petitioners claim that they were not served with the cancellation proceedings cancelling their assignment, a direction is issued to the seventh respondent to serve a copy of the cancellation proceedings dated 30.10.2000 cancelling the petitioners’ assignment to the petitioners within a period of four weeks from the date of receipt of a copy of this order. The petitioners are also granted liberty to challenge the cancellation proceedings dated 30.10.2000 in the manner known to them under law. With the aforesaid direction, this writ petition is disposed of. W.M.P.No.36208 of 2024 is ordered subject to payment of separate court fee. No Costs.
