(Order of the Court was made by G.K.ILANTHIRAIYAN, J.
This Habeus Corpus Petition has been filed to direct the respondents herein to produce the body or corpus of the petitioner's daughter Deva Dharshini aged 22 W/o.Surya, detenue herein before this Court and set her at liberty forthwith
2. The petitioner is the mother of the detenu. The detenue was married to one Surya on 04.05.2025 and was living in Bangalore. After some time on 30.06.2025 the daughter of the petitioner had left the matrimonial home and her whereabouts not known. Hence the petitioner has lodged complaint before the Inspector of Police, Hoskote Sub Division, Bangalore and it is pending for investigation. In the meanwhile, the petitioner being mother of the detenue lodged complaint before the third respondent and it is pending enquiry. On enquiry the third respondent found that the already the husband of the detenue lodged complaint before the jurisdiction police and the same is pending investigation. That apart the detenue left the matrimonial home from Bangalore, therefore the compliant was closed on the ground of territorial jurisdiction. Further the detenue while living with her husband had left the matrimonial home at Bangalore, in view of the same, the present petition is not maintainable before this Court and the same is liable to be dismissed.
3. Accordingly, the petition stands dismissed.
