Prayer : Habeas Corpus Petition filed under Article 226 of the Constitution of India praying to issue to writ of habeas corpus or any other appropriate writ, or order, or direction, in the nature of writ and direct the 2nd respondent herein to produce the body of the petitioner’s daughter N.Tejaswini, D/o.K.Nandakumar, female, aged about 18 years who has been illegally detained by the 3rd respondent and set her at liberty.

O R D E R

(Order of the Court was made by P.Velmurugan J.)

This petition has been filed seeking a direction to the second respondent to produce the petitioner's daughter N.Tejaswini, D/o.K.Nandakumar, aged about 18 years, who is alleged to be illegally detained by the third respondent, and set her at liberty.

2. On the earlier occasion, i.e., on 02.02.2025, this Court passed the following order :

“The detenue / N.Tejaswini and R3 / R.Deemanth had surrendered to the official respondents and are produced in the court today along with their respective family members.

2. We had conversed both with R3 as well the detenue.

They state that their ages are 20 years (DOB of R3 is 10.07.2006) and 18 years and 1 month (DOB of detenue is 07.12.2007). Acceptable age proof of both R3 and detenue shall be produced as only the Aadhar card of detenue is produced before us.

3. The detenue claims to have married R3 in a temple in end December, 2025. She is categoric that she will not return to her parental home. She does not feel the necessity to do so seeing as she is a major, and also as she states that she apprehends threat to her life at the hands of her family.

4. R3 with whom we spoke, states that he has discontinued the B.Tech course after the second year and is now employed. He appears to be of the view that they should wait for some time before settling down as a couple.

5. For the present, let the authorities handover custody of the detenue to the Annai Sathya Home, Pillayar Palayam, Kanchipuram. The parents of the detenue are at liberty to interact with her in the home and they may avail the benefit of counselling provided there.

6. R3 resides with his family. Learned Additional Public Prosecutor is requested to suggest a counsellor to counsel R3 and his family as well, in order to enable all parties to arrive at an amicable resolution to the matter.

7. List on 16.02.2026.”

3. Today, when the matter was taken up for hearing, the detenue, was produced before this Court. On enquiry, she has stated that she had voluntarily left her parental home, as she was unable to withstand the pressure exerted by the petitioner and had gone along with the third respondent on her own free will. She further stated that she apprehends threat to her life at the hands of her family and that she will not return to her parental home.

4. Since the detenue is a major, who is found to be safe, and there is no material to indicate any illegal detention, this Court finds no reason to interfere with this petition. There is no necessity to send the detenue to any Government Home or Shelter Home.

5. In view of the above, this Habeas Corpus Petition is closed.
