ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents 1 and 2 to take appropriate action as against the respondents 3 to 7 for violating the Rule 11 of byelaws of Tamilnadu Forest Plantation Corporation Trade Union in Registration No.262/1978, by considering the petitioner's application dated 04.02.2026.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. Since no adverse orders are going to be passed against the respondents 3 to 7, notice to the respondents 3 to 7 is hereby dispensed with.
4. The learned counsel for the petitioner submits that the respondents 3 to
7, who were elected as Office Bearers of the petitioner's Union, have acted in contravention of Rule 11 of the said Trade Union Byelaws, thereby violating the governing rules of the Union. Hence, the petitioner has submitted an application dated 04.02.2026 to the respondents 1 and 2, bringing the said violations to their notice and requesting appropriate action in accordance with law. However, despite receipt of the said application, the respondents 1 and 2 have not taken any action so far, nor have they passed any orders on the petitioner’s application.
Hence, the present Writ Petition.
5. The learned Government Advocate appearing for the respondents 1 and 2 would submit that the petitioner's application will be considered and appropriate orders will be passed on merits and in accordance with law within a time frame to be fixed by this Court.
6. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the respondents 1 and 2 to consider the petitioner's application dated 04.02.2026, and pass appropriate orders on merits and in accordance with law after providing reasonable opportunity of hearing to the petitioner, the respondents 3 to 7 and any other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
