Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of certiorarified mandamus calling for the records relating to the proceedings of the 4^th respondent in Proceedings No.08/2025 in Na.Ka.No. 2223/2025/D1 dated 03.02.2026 passed by the 4^th respondent culminating in the impugned Lock and Seal Order issued in respect of the petitioner's premises situated at Ward C2, Block No.17, T.S.Nos.1487, 1488 and 1489/1 (Old No.101/1489, 1488), Kumbakonam Municipality and quash the same as illegal, arbitrary and consequently direct the respondents to forthwith de-seal the petitioner's premises pending disposal of the statutory appeal filed by the petitioner under Section 80-A, dated 10.02.2026, on the file of the first respondent.

Mr.D.Sasi Kumar, learned Additional Government Pleader, takes notice for the respondents 1 to 3 and Mr.B.Jameel Arasu, learned counsel, takes notice for the fourth respondent.

2. Pursuant to the directions issued by this Court, the unauthorized construction put up by the petitioner has been locked and sealed by the fourth respondent. Challenging the lock and seal proceedings, this writ petition is filed.

3. Learned Additional Government Pleader appearing for the respondents 1 to 3, on instructions, submits that the remedy available to the petitioner is to prefer a revision before the authority concerned under Section 80-A of the Tamil Nadu Town and Country Planning Act, 1971 and the petitioner has also availed the right of revision by filing a revision before the Government on 10.02.2026.

4. In view of the above submission, the petitioner cannot parallelly invoke the writ jurisdiction. If the petitioner has any grievance with regard to the sealing of his approved structure, it is for him to approach the authority concerned and get his approved portion desealed.

5. With the above observation, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
