(Order of the Court was made by DR.G.JAYACHANDRAN The Writ Petition is filed to quash the impugned notice, dated

5.1.2026, wherein, the Writ Petitioner was directed to remove the encroachment put up in Vacant Parai(rock).

2.Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3.When the matter came up for consideration, the Petitioner submitted that there are several other encroachers and he alone has been victimized by causing notice. To ascertain whether his allegation is correct and he alone been pick and chose for eviction, we direct the first respondent/Tahsildar to file a status report. Pursuant to the direction of this Court, dated 30.1.2026, the status report along with photos was filed by the first respondent/Tahsildar, wherein, it is stated that the Petitioner was issued notice under Section 6 of the Tamil Nadu Land Encroachment Act to remove the illegal occupation and unauthorized structure put up on the Government poramboke land. The Petitioner made a request to regularize his illegal occupation by issuing house patta and that was considered and rejected by the authorities on 23.12.2025 and Section 6 notice was issued for removal of the encroached structure in S,F,No. 56/44 part in Aaraikulam Village, Palayamkottai Taluk, Tirunelveli. Regarding the allegation that he alone been victimized, the Tahsildar in his notice had stated that in view of the guidelines issued by the Government for regularizing the residence in objectionable Poramboke land, survey been conducted in that area. Out of 21 encroachers, six were found ineligible and rest satisfied the parameters for grant of patta. Hence the Revenue Authorities are examining their eligibility to get patta and rest of the encroachers were asked to evict and due process has been commenced.

4.Taking into consideration the status report filed by the Tahsildar, we find that as far as the Petitioner is concerned, who has put up structure on the Government Poramboke Parai, is not eligible to regularize the illegal occupation and insofar as his allegation about discrimination, the status report is self explanatory. Hence the Writ Petition deserves no merit for consideration.

5.Accordingly, the Writ Petition stands dismissed. No costs.

Consequently, connected Miscellaneous Petitions are closed.
