O R D E R

The present writ petition has been filed seeking a writ of mandamus directing the respondents to forbear from constructing any drainage channel in the petitioner’s patta land comprised in Survey No.52/1B, situated at Kalloorani Panchayat, Pavoorchathiram, Tenkasi District, without following due process of law.

2. The fifth respondent has filed a counter affidavit. Paragraph No.6 of the counter affidavit is extracted hereunder:

“6. It is humbly submitted that the Drainage work would be carried over the lands at S.F.No.52/8, 53/6, 49/6, 48, 66/4, 63/8, 21/6 which is a Public Pathway and the drainage will be at the side-edge of that public pathway, hence because of this public work no individual's land is disturbed.”

3. The learned counsel appearing for the fifth respondent submitted that the petitioner’s patta land has not been disturbed and that the proposed drainage would be laid only in the survey numbers mentioned in paragraph No.6of the counter affidavit. An undertaking has also been given that the petitioner’s patta land will not be disturbed.

4. Recording the above submission and undertaking, this writ petition stands closed. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
