ORDER

This Court passed an order to consider the claim of the petitioner for compassionate appointment.

2. Now the competent authority passed an order stating that the 1^st application seeking compassionate appointment was not pursued, and the 2^nd application by another legal heir was not submitted within a period of one year, but submitted after a lapse of about 18 years. Authorities found discrepancies in the legal heirship certificate and further found that deceased employee had two wives. On account of these discrepancies, authorities have rejected the application seeking compassionate appointment. However, this Court has directed the authorities to verify all these facts while considering the applications, which has been done.

3. Learned counsel for the petitioner made a submission that certain observations were made in the order passed by this Court.

4. However, such observations are only guiding observations for the authorities to determine the issues in the right perspective, and more specifically under the terms and conditions of the scheme of compassionate appointment. Once the authorities found that the person is not eligible for compassionate appointment, petitioner cannot rely on such observation for the purpose for securing appointment in a contempt proceeding.

5. Thus, respondents have not committed any disobedience warranting contempt proceeding. Consequently, the contempt petition stands closed. No costs.
