2. This Transfer Civil Miscellaneous Petition is filed seeking withdrawal of I.D.O.P. No.175 of 2024 pending on the file of the Family Court, Chengalpattu, and transfer thereof to the Family Court, Kanyakumari at Nagercoil, with a further request to conduct a joint trial along with G.W.O.P.

No.204 of 2024 pending before the Family Court, Kanyakumari at Nagercoil.

3. The petitioner is the wife. The marriage between the petitioner and the respondent was solemnized on 19.01.2018, as per Christian rites and customs at CSI Christ Church, Kanchipuram. It is stated that she is residing at Kanyakumari District (Nagercoil). It is also stated that the respondent-husband has already instituted G.W.O.P. No.204 of 2024 at Nagercoil and, at the time of such filing, the children were residing with the petitioner at Kanyakumari District.

Having regard to the circumstances placed, including (i) the petitioner-wife’s place of residence at Kanyakumari District, (ii) pendency of the guardianship proceedings at Nagercoil, and (iii) the need to avoid multiplicity and the possibility of inconsistent findings in connected matrimonial/child-custody issues, this Court is satisfied that the request for transfer deserves acceptance.

5. Accordingly, Tr.C.M.P. No.886 of 2024 is allowed, I.D.O.P.

No.175 of 2024 is withdrawn from the file of the Family Court, Chengalpattu and transferred to the file of the Family Court, Kanyakumari at Nagercoil. The Family Court, Chengalpattu shall transmit the entire records to the Family Court, Kanyakumari at Nagercoil within three weeks from the date of receipt of a copy of this order. The Family Court, Kanyakumari at Nagercoil shall take up the transferred I.D.O.P. along with G.W.O.P. No.204 of 2024 and proceed in accordance with law, as expeditiously as possible, uninfluenced by any observation made in this order. No costs. Consequently, connected miscellaneous petition is closed.
