For Petitioner : Mr.M.Ananthkumar For R1 & R2 : Mr.B.Ramanathan Additional Government Pleader For R3 : Mr.S.Kumar O R D E R This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to cancel Patta No.166 granted in the name of the third respondent’s father, Dharmathevar, by conducting a proper enquiry based on the petitioner’s representation dated 11.08.2025.

2. The grievance of the petitioner is that the property in Survey No.

309/1A, measuring an extent of 8085 sq.ft., situated at Melapattam Village, Palayamkottai Taluk, Tirunelveli District, belongs to the petitioner and that he had bequeathed the same to his daugher under a registered Will dated 17.06.2011. However, at the instance of the third respondent, though they have no right over the property, Patta No. 166 has been issued in the name of her father in respect of the subject property with an intention to grab the same. Therefore, the petitioner submitted a representation dated 11.08.2025 to the first respondent seeking cancellation of the said patta. Since no action has been taken thereon, the petitioner has been constrained to file the present Writ Petition.

3. The learned Additional Government Pleader appearing for the first and second respondents, on instructions, would submit that the petitioner's representation dated 11.08.2025 would be considered and appropriate orders would be passed by the first respondent within a period of sixteen weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to consider the petitioner's representation dated 11.08.2025, conduct enquiry and pass appropriate orders on its merits and in accordance with law within a period of sixteen weeks from the date of receipt of a copy of this order. The factum of the earlier civil proceedings shall be taken into consideration while conducting the enquiry and passing orders. The first respondent is also directed to provide a reasonable opportunity of hearing to the petitioner, third respondent and any other interested parties who may be affected by such decision, before passing any order. There shall be no order as to costs.
