O R D E R

The present writ petition has been filed seeking a Mandamus directing the respondent to renew and reissue the passport of the petitioner by changing the date of birth of the petitioner from 04.02.1968 to 21.04.1973.

2. According to the learned counsel appearing for the writ petitioner, when the passport was initially issued in the year 1991, the date of birth was wrongly mentioned as 04.02.1968. However, his correct date of birth is 21.04.1973. According to him, except the passport, all other government records indicate the date of birth of the petitioner only as 21.04.1973.

Therefore, the present request has been made.

The learned Central Government Standing Counsel appearing for the respondent submitted that initially passport was issued in the year 1991, the petitioner has renewed it in the year 2014, for the past 30 years the petitioner is maintaining a passport with the date of birth as 04.02.1968 and he has travelled all over the world. Now no proper reasons have been assigned to change the date of birth from 04.02.1968 to 21.04.1973. He also relied upon the Division Bench Judgment of this Court in W.A(MD)No.1510 of 2018 dated 08.11.2018 (H.Albert Vs. the Regional Passport Officer) wherein in paragraph No.4(b) it is held as follows:

“ b) Having regard to the admitted fact that the appellant who is holding a passport for more than 34 years by showing his identity as a person born on 14.05.1960, has travelled abroad several times and has worked for several years in abroad with this identity, the request of the appellant, after this length of time, cannot be considered by this Court on the basis of his school certificate or other documents relied upon by the appellant.”

4. Heard both sides and perused the materials available on record.

Considering the fact that the petitioner is holding the passport for more than 30 years with his date of birth as 04.02.1968 and no legally acceptable reasons have been brought before this Court for altering the date of birth from 04.02.1968 to 21.04.1973, this Court is not inclined to entertain the present writ petition, especially in the light of the Division Bench Judgment cited supra.

6. In view of the above said facts, the request of the writ petitioner for alteration of date of birth is hereby rejected. However, the respondent is directed to renew the passport with the date of birth of the petitioner as

04.02.1968 on the basis of fresh application submitted by the writ petitioner.

7. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
