O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second respondent to dispose of the petitioner’s application in Na.Ka.No. 9387/2023 in accordance with law and within a stipulated time.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the fourth respondent, as no adverse orders are proposed to be passed against him.

3. The grievance of the petitioner is that he is the absolute owner of the property in Survey No. 210/2A2, measuring an extent of 1 acre and 9 cents, situated at Keelayur Village, Ilayankudi Taluk. Patta has been issued in his name. However, the computerised patta was erroneously issued in the name of the fourth respondent in respect of the said property, though he has no connection with the land and is in possession only of the property in Survey No. 195/7B, which is classified as a water body in the revenue records. The revenue records, namely the ‘A’ Register and Adangal, clearly reflect that the patta relating to the property stands in the name of the petitioner. Therefore, the petitioner submitted an application before the second respondent under Section 12 of the Tamil Nadu Patta Pass Book Act seeking rectification of the mistake. Though the said application has been taken on file in Na.Ka.No. 9387/2023, no orders have been passed thereon. Hence, the petitioner has been constrained to file the present Writ Petition.

4. The learned Government Advocate appearing for the first to third respondents, on instructions, would submit that the petitioner's application in Na.Ka.No.9387/2023 would be disposed of by the second respondent within a period of eight weeks.

5. Recording the above submissions and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to dispose of the petitioner's application in Na.Ka.No.9387/2023 on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. The application shall be disposed of after conducting an enquiry. The second respondent shall afford a reasonable opportunity of hearing to the petitioner, the fourth respondent and all other interested parties before passing orders. In the event of any rival claims, the parties are at liberty to work out their remedies before the competent Civil Court. No costs.
