Prayer : Writ Petition filed under Article 226 of the Constitution of India to issue Writ of Mandamus, directing the respondents 1 to 3 to disburse the salary arrears of petitioner from 01.06.2009 to 21.10.2019 with all attendant consequential benefits.

ORDER

Mr.M.R. Gokul Krishnan, learned Additional Government Pleader takes notice for the respondents 1 to 3. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

2. It is the case of the petitioner that he was initially appointed under Self-

financing scheme on 01.06.2004. Subsequently, he was appointed as Gardener in the 4^th respondent College against a sanctioned vacancy arising due to promotion with effect from 01.06.2009. It is the grievance of the petitioner that despite being appointed against a sanctioned post, he was not paid salary from 01.06.2009. Thereafter, he ventilated his grievances before the respondents and also submitted a representation on 02.07.2025 seeking direction to the respondents 1 to 3 to disburse the salary arrears of petitioner from 01.06.2009 to 21.10.2019 with all attendant consequential benefits. But the same was not considered, till date. Hence this writ petition.

3. Learned counsel for the petitioner submits that it would suffice, if a direction is issued to the respondents 1 to 3 to consider the representation of the petitioner, dated 02.07.2025 seeking disbursal of salary arrears and consequential benefits, within a time frame to be fixed by this Court.

4. Mr.M. R. Gokul Krishnan, learned Additional Government Pleader appearing for the respondents 1 to 3 has no serious objection in issuing such a direction to the respondents. However, he submits that the 3^rd respondent is the competent authority to consider the petitioner's representation and accordingly he prays for issuance of appropriate directions. Since no adverse orders are passed as against the 4^th respondent, notice to the 4^th respondent is dispensed with.

In view of the fair stand taken by the learned counsel on either side, this Court, without going into the merits of the case, directs the 3^rd respondent to consider the petitioner's representation, dated 02.07.2025 with regard to disbursement of petitioner’s salary arrears and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

6. With the above directions, the writ petition stands disposed of. No costs.
