Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus, calling for the records of the 3rd respondent herein, Impugned Proceedings in CV INTIMATION NO.19/MRB/2025, dated 21.01.2026 and consequential provisional selection list in PSL No -02/MRB/2026, dated 30.01.2026 of the 3rd respondent and quash the same, consequentially, direct the respondents to continue the selection process for the post of field assistant strictly in accordance with the Notification NO.19/MRB/2025, dated 09.12.2025 of the 3rd respondent by selecting the persons who have completed (One Year duration course) i.e., CMLT alone.

ORDER

Challenging the impugned Proceedings in CV INTIMATION NO.19/MRB/2025, dated 21.01.2026 and consequential provisional selection list in PSL No -02/MRB/2026, dated 30.01.2026 of the third respondent, the present Writ Petition has been filed. Further, the petitioners have sought for a direction to the respondents to continue the selection process for the post of Field Assistant strictly in accordance with the Notification NO.19/MRB/2025, dated 09.12.2025 of the third respondent by selecting the persons, who have completed (One Year duration course) i.e., CMLT alone.

2. Heard the learned counsels appearing on either side and also perused the materials placed on record. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

3. The brief facts of the case is as follows:

3.1. The petitioners have completed SSLC, HSC and one year Medical Laboratory Technician Course. They applied through on-line for the posts of Field Assistant issued by the respondents under Notification No.19/MRB/2025 dated 09.12.2025 and secured weightage marks 53.28 and 52.40 respectively. Though they are eligible as per the aforesaid notification, the persons who have completed two years course have been called for certificate verification and the provisional selection list was also published. As per G.O.No.549, Health & Family Welfare Department, dated 08.12.2025, direct recruitment was stopped for the Lab Technician Grade-II for the Diploma courses and contrary to that, the third respondent accepted the applications from Diploma holders and published the provisional selection list on 30.01.2026. Aggrieved by the same, the present Writ Petition has been filed.

The learned counsel for the petitioners submitted that the required qualification as per the aforesaid notification is that the candidates should possess HSC and one year Medical Laboratory Technician Course acquired from any institution recognised by the Director of Medical Education and must have a good physique, vision and capacity to do outdoor work. He further submitted that the respondents have accepted the applications from Diploma holders, who have secured higher marks and selected for the posts, which deprived the petitioners for selection. Hence, aggrieved by the publication of the provisional selection list by the respondents, the present Writ Petition is filed.
