ORDER

This Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.415 of 2025 pending on the file of the first respondent.

2. The case of the prosecution is that the petitioner, along with another accused, was found to be in possession of 1,300 grams of ganja. Hence, the case.

3. The learned counsel for the petitioner submitted that based on a false case, the petitioner was taken into custody on 18.12.2025 at 5.45 am., from his house and was kept in illegal detention. However, while registering the case, the first respondent has mentioned that the petitioner was arrested at 9.15 a.m., at Vyasarpadi, Kalyanapuram. Thus, the entire allegation is false. Hence, the petitioner seeks to quash the First Information Report against him.

The learned Government Advocate (Crl.Side) appearing for the first respondent submitted that 1,300 grams of ganja was recovered from the petitioner and A2, namely, one Tamizhazhagan and that the case was registered on 18.12.2025. He further submitted that the investigation is at a nascent stage.

He also submitted that the petitioner is a history-sheeter.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the first respondent and perused the materials available on record.

6. It is the case of the petitioner that he was taken from his house at about 5.45 a.m. on 18.12.2025 and later, shown to have been arrested at 9.15 a.m., at Vyasarpadi, Kalyanapuram. The petitioner also claims that he has CCTV footage to the effect that he was picked from his house at 5.45 a.m. on

18.12.2025.

7. Taking into consideration the facts and circumstances of the case and the submissions made by the learned counsel on either side, this Court directs the first respondent to conduct a proper and fair investigation by duly considering the materials produced by the petitioner, including the CCTV footage relied upon by him and to file the final report as expeditiously as possible, in accordance with law.
