Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to pass orders for granting promotion to the petitioner to the post of Under Secretary based on the panel for the year 2018 issued by the second respondent in Proceedings No.5205/PD-E1/2017 dated 16.04.2018, without reference to subsequent charge memo issued by the second respondent dated 25.10.2019, in consideration of representation submitted by the petitioner dated 14.09.2023, with all consequential and other attendant benefits.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents to pass orders for granting promotion to the petitioner to the post of Under Secretary based on the panel for the year 2018 issued by the second respondent in Proceedings No.5205/PD-E1/2017 dated 16.04.2018, without reference to subsequent charge memo issued by the second respondent dated 25.10.2019, in consideration of representation submitted by the petitioner dated 14.09.2023, with all consequential and other attendant benefits.

2.The learned Senior Counsel appearing for the petitioner submitted that the petitioner is working as Section Officer and the next avenue of promotion is to the post of Under Secretary and she made representation dated 14.09.2023 to the respondents seeking to granting promotion to the petitioner to the post of Under Secretary based on the panel for the year 2018 issued by the second respondent in Proceedings dated 16.04.2018, without reference to subsequent charge memo issued by the second respondent dated 25.10.2019, however, there is no response. Hence, this Court may without going into the merits of the case, issue direction to the respondents to consider the petitioner's representation dated 14.09.2023 and to pass appropriate orders, within a reasonable time frame.

3.Considering the limited relief now sought for by the learned Senior Counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, directs the respondents to consider the petitioner's representation dated 14.09.2023, on merits and in accordance with law and to pass appropriate orders, within a period of twelve weeks from the date of receipt of a copy of this order.

4.The writ petition is disposed of. No costs.
