O R D E R

The petitioner, who was working as District Registrar in the Registration Department retired from service on attaining the age of superannuation on 30.09.2013. The petitioner, with a grievance that his juniors have been promoted to the post of Assistant Inspector General of Registration has submitted a representation to the respondents on 14.02.2022, seeking notional promotion with effect from 27.09.2013, however, the same has not been considered by them. Therefore, the petitioner has moved a writ petition before this Court in WP(MD) No.5929 of 2022 and the same was disposed of by this Court, by order, dated 21.10.2024 with a direction to the respondents to consider the petitioner’s representation. With a grievance that the request of this petitioner has not been considered even after the directions of the earlier order of this Court in WP(MD) No. 5929 of 2022, dated 21.10.2024, the petitioner has filed this writ petition.

2.Mr.G.V.Vairam Santhosh, learned Additional Government Pleader takes notice for the respondents and based on the written instructions provided by the Inspector General of Registration, Chennai in a letter No. 6035/A1/2022, dated 06.02.2026 submits that the case of this petitioner is under consideration and a decision would be taken within a period of eight weeks.

3.This Court considered the rival submissions made and also perused the materials placed on record.

4.This petitioner has filed a writ petition before this Court in WP(MD) No.1529 of 2022 in earlier occasion for the very same relief that he has not been promoted notionally to the post of Assistant Inspector General of Registration as that of his juniors and this Court has also disposed of that writ petition, by order, dated 21.10.2024, with a direction to the respondents to consider his representation. In the event, if the respondents have not obeyed/complied the order of this Court, the petitioner ought to have filed a contempt petition. Instead, the petitioner has moved the present writ petition for the very same relief.

Since the prayer sought for in this writ petition has already been considered by this Court in earlier occasion in WP(MD) No.1529 of 2022, dated 21.10.2024 and directions were issued to the respondents to consider the petitioner’s representation, this Court is not inclined to entertain this writ petition, which is filed for the very same relief.

6. Accordingly, this writ petition is dismissed. In the event, if the respondents are not taking any decision on the representation of this petitioner, the petitioner is at liberty to file a contempt petition. No costs.
