ORDER

Heard Mr.D.Rajagopal, learned counsel for the revision petitioner.

2. The revision petitioner is the decree holder. Having obtained decree

in O.S.No.281 of 1998, the petitioner filed E.P.No.31 of 2021 and the

executing decree is in his favour. The grievance of the petitioner is that the

execution petition is pending for the last five years without any sufficient

progress and seeks limited direction for expeditious disposal of the

execution proceedings.

3. The Hon’ble Supreme Court has time and again held that the

execution petition should not be kept in cold storage and should be disposed

of preferably within six months.

4. In the light of the above, I am inclined to entertain the civil revision

petition by dispensing with notice to the respondents as this order will not in

any way prejudice the rights of the respondents. The executing Court viz.,

District Munsif Court, Gudiyatham shall expedite the proceedings in

E.P.No.31 of 2021 in O.S.No.281 of 1998 and dispose of the same on merits

by 30.06.2026.

5. With the above direction, the civil revision petition is allowed. No

costs.
