M. Dhandapani, J
P.RAMU – Appellant
Versus
The Principal secretary/Commissioner of Labour – Respondent
WP No. 3914 of 2026
For the Appellants/Petitioners: V.R. Kamalanathan
For the Respondents: P. Balathandayutham
The court directed the respondents to consider and decide upon a representation regarding the disbursement of terminal benefits, including gratuity and leave encashment, within a stipulated timeframe of six weeks.
Headnote:The petition was filed under Article 226 of the Constitution of India seeking a Writ of Mandamus to direct the second respondent to consider a representation dated 02.09.2024. The petitioner sought the disbursement of gratuity, Special Provident fund, and encashment of earned and unearned leave on private affairs, which had not been considered by the respondents. The core issue was whether the respondents should be directed to dispose of the pending representation within a specific timeframe. The court noted the submission of the respondents' counsel that the representation would be considered and an appropriate order would be passed. The respondents are directed to pass final orders on merits and in accordance with law on the petitioner’s representation, dated 02.09.2024, within a period of six (6) weeks from the date of receipt of a copy of this order.
