ORDER

This Writ Petition has been filed seeking a direction to the respondents to fix the petitioner’s seniority on par with his batch mates recruited in the year

2007 – 2008.

2. Mr.R.U.Dinesh Rajkumar, learned counsel takes notice on behalf of the respondents. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.

3. The case of the petitioner is that the petitioner applied for the post of Grade II Police Constable for the recruitment year 2007 – 2008, and was duly selected. While the petitioner was awaiting issuance of the appointment order, a complaint came to be registered against him in Cr.Nos.2488 and 2489 of 2008, owing to the said pendency, the appointment order was issued to the petitioner belatedly on 23.01.2013. Therefore, in order to have his seniority fixed on par with his batch mates, recruited during the year 2007 – 2008, he made representations dated 06.09.2013 and 14.12.2015 before the respondents.

However, the same has not been considered till date. Therefore, the petitioner has preferred the present Writ Petition.

Learned Counsel appearing for the petitioner submits that it would suffice, if this Court issues a direction to the respondents to consider the representation of the petitioner dated 06.09.2013 and 14.12.2015, and pass appropriate orders on the same within the time that may be stipulated by this Court.

5. On the above contention, this Court heard the learned counsel appearing for the respondent.

6. In view of the limited relief sought for by the petitioner, this Court without expressing any opinion on the merits of the case, directs the petitioner to make a fresh representation before the respondents within a period of two (2) weeks from the date of receipt of a copy of this order. Upon receipt of the said representation, the respondents are directed to consider the same on merits and pass appropriate orders in accordance with law within a period of four (4) weeks thereafter, after affording an opportunity of hearing to the petitioner and any other interested parties.

7. This Writ Petition stands disposed of with the aforesaid direction.

There shall be no order as to costs.
