WP CRL.(MD). No.524 of 2026

Advocates:
For the Appellants/Petitioners: G. Gomathisankar
For the Respondents: A.S. Abul Kalaam Azad, Muthu Manikkam

A political banner affixed to private property without the consent of the owner or permission from the local authority must be removed by the concerned officials.

Headnote:The petitioner filed a Writ Petition under Article 226 of the Constitution of India seeking a Writ of Mandamus to direct the respondents to remove a political banner affixed to the petitioner's property in Athipaakkam Village, Thanjavur District, following a representation dated 05.01.2020. The court found that the banner was placed on the wall without obtaining the necessary prior permission from the local authority or the property owner. The central issue was whether the respondents were required to remove a banner placed without authorization on private property. The court reasoned that since the banner was affixed without permission from both the local authority and the owner, it was an unauthorized act and must be removed forthwith. With the above direction, this Writ Petition is disposed of.
