Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned order passed by the third respondent in Na.Ka.

No.2492/A1/2025 dated 14.08.2025 and to quash the same and consequently, directing the respondents to promote the petitioner by recruitment by transfer to the post of Record Clerk or in the post of Office Assistant or in the post of Junior Assistant, considering the services rendered by the petitioner for more than 32 years of service as Sweeper with more than 15 years of service in the Special Time scale of pay based on the qualification of the petitioner, on par with similarly placed persons granted regular appointment / promotion with all consequential and other attendant benefits, within a time frame.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus to call for the records relating to the order passed by the third respondent in Na.Ka.No.2492/A1/2025 dated 14.08.2025 and to quash the same and consequently, direct the respondents to promote the petitioner by recruitment by transfer to the post of Record Clerk or in the post of Office Assistant or in the post of Junior Assistant, considering the services rendered by the petitioner for more than 32 years of service as Sweeper with more than 15 years of service in the Special Time scale of pay based on the qualification of the petitioner, on par with similarly placed persons granted regular appointment / promotion with all consequential and other attendant benefits, within a time frame.

2.The learned counsel appearing for the petitioner submitted that the petitioner is employed as Sweeper in the third respondent office and the petitioner made representation to the respondents seeking to promote the petitioner by recruitment by transfer to the post of Record Clerk or in the post of Office Assistant or in the post of Junior Assistant and the petitioner’s claim was rejected by the respondents. The learned counsel further submitted that without going into the merits of the case, this Court may permit the petitioner to make representation to the respondents seeking promotion after moving to the regular time scale of pay in the post of Sweeper.

3.The learned Special Government Pleader submitted that as soon as the petitioner is provided regular time scale of pay, the petitioner may be granted liberty to make fresh representation to the respondents seeking promotion in terms of G.O.Ms.No.60, Personnel and Administrative Reforms Department, dated 27.04.2006.

4.In view of the submissions made on either side, this writ petition stands disposed of. Liberty is granted to the petitioner to make representation to the respondents seeking promotion, immediately after the grant of regular time scale of pay, in terms of G.O.Ms.No.60, Personnel and Administrative Reforms Department, dated 27.04.2006. No costs. Consequently, the connected miscellaneous petition is closed.
