This Writ Petition filed under Article 226 of the Constitution of

India, in the nature of Writ of Certiorari, to call for the records of the Tribunal

in its impugned order dated dated 29.07.2024 in O.A. No. 537 of 2020 passed

by Central Administrative Tribunal, Chennai Bench and to quash the same

ORDER

(Order of the Court was made by K.Kumaresh Babu, J.)

Toady, when the matter was taken up for hearing, a counter affidavit was

filed by the 1^st respondent, who is the successful applicant, indicating that he

had appeared for a subsequent examination, for promotion to the cadre of

Assistant Accounts Officer and had been successfully promoted to the said post

and therefore, he is not pressing the relief sought for in the original application.

In this connection, paragraph No.11 of the counter affidavit is extracted

hereunder:

“11.I state that in the meanwhile I appeared for LDCE for

promotion to the cadre of AAO (Assistant Accounts Officer) during

May 2022. I have been declared as qualified and promoted as AAO

on 02.12.2022 and posted at PAO (Postal Accounts Office),

Jharkhand. Now, I am working as AAO at PAO, Chennai, Tamil

Nadu Circle from 01.12.2025. Therefore, I want to continue to

work as AAO and thereby I am not pressing for any relief for the

post of IP for which I have filed OA No.537 of 2020 before the

Hob’ble Tribunal.”

2.However, the learned counsel for the petitioners would submit that the

issues of law, upon which the Tribunal had passed the order, would have to be

visited by this Court.

3.Considering the fact fact that the 1^st respondent / applicant himself had

given up his right for promotion, which has been granted to him by the

Tribunal, we propose not to enter upon the issue and leave it open to be agitated

in an appropriate case. In view of the same, this Writ Petition stands closed. No

costs. Consequently, connected Writ Miscellaneous Petition is closed.
