Prayer Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the 1st respondent to consider and pass orders on the petitioner’s representation dated 24.01.2024, regarding fixation of her seniority from 01.08.2001 i.e., the date of the original appointment in the light of Rule 16-B of Special Rules for Tamilnadu Police Subordinate Service Rules 1978 and in the light of the order passed in the Rc.No.A2/003967/183/2025 dated 15.10.2025 with all consequential service and monetary benefits within a time frame as deem fit and proper by this Hon’ble Court.

ORDER

The present Writ Petition has been filed seeking a direction to the 1st respondent to consider and pass orders on the petitioner’s representation dated 24.01.2024, regarding fixation of her seniority from 01.08.2001 i.e., the date of the original appointment in the light of Rule 16-B of Special Rules for Tamilnadu Police Subordinate Service Rules 1978 and in the light of the order passed in the Rc.No.A2/003967/183/2025 dated 15.10.2025 with all consequential service and monetary benefits within a time frame to be fixed by this Court.

2. Mr.P.Balathandayutham, learned Special Government Pleader takes notice on behalf of the respondents.

3. The petitioner joined the Police Department as Grade II Police Constable on 01.08.2001. As she was found to be pregnant at the relevant point of time, she was permitted to undergo training along with subsequent batch and hence, she was relieved from service on 31.03.2002, After availing maternity leave, she resumed duty on 08.05.2003. Subsequently, she was promoted as Grade I Police Constable on 01.06.2013 and further as Head Constable on 01.06.2018. However, her seniority has been fixed with effect from 08.05.2003 being the date on which, she resumed duty instead of the date of her original appointment. Therefore, the petitioner submitted a representation dated 24.01.2024 requesting fixation of her seniority from the date of original appointment. However, till date, the same has not been considered. Hence, the present Writ Petition.

4. Learned counsel for the petitioner submitted that it would suffice, if this Court issues a direction to the respondents to consider the petitioner’s representation dated 24.01.2024 and pass appropriate orders on the same within the time that may be stipulated by this Court.

5. Learned Special Government Pleader appearing for the respondents submitted that, as on date, the petitioner has not submitted any representation with regard to fixation of her seniority.

In view of the limited relief sought for in this Writ Petition, this Court without expressing any opinion on the merits of the case, directs the petitioner to submit copy of representation dated 24.01.2024 to the 1st respondent seeking fixation of seniority within a period of two (2) weeks from the date of receipt of a copy of this order and upon receipt of the same, 1st respondent is directed to consider the same and pass appropriate orders on merits and in accordance with law within a period of six (6) weeks thereafter, after affording an opportunity of hearing to the petitioner and any other interested parties.

7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
