Prayer Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents to consider and pass orders on the petitioners representation dated 7.5.2025 to promote the petitioners in an appropriate post based on the seniority list maintained with the respondents within a stipulated time.

ORDER

The present Writ Petition has been filed seeking a direction to the respondents to consider and pass orders on the petitioner’s representation dated 7.5.2025 and to promote them in an appropriate post based on the seniority list being maintained with the respondents within the time limit fixed by this Court.

2. Mr.E.Senniyangiri, learned Government Advocate takes notice on behalf of RR-1 & 2 and ,Mr.M.Rajendiran, learned Additional Government Pleader takes notice on behalf of the R-3.

3. The petitioner was appointed as Salesman in the 3rd respondent Society on 25.08.1998. He was placed under suspension the year 2004 for the alleged irregularities. After series of litigations before this Court, the petitioner was reinstated into service and has been continuing his service till date. The petitioner claiming to be eligible for promotion to the next higher post in accordance with the seniority list maintained by the respondents, submitted a representation dated 07.05.2025 to the respondents requesting for grant of promotion. However, the said representation has not been considered so far.

Hence, the present Writ Petition.

4. Learned counsel for the petitioner submitted that it would suffice, if this Court issues a direction to the respondents to consider the petitioner’s representation dated 07.05.2025 and pass appropriate orders on the same within the time that may be stipulated by this Court.

5. On the above contention, this Court, heard the learned Government Advocate appearing for the 1st and 2nd respondent and learned Additional Government Pleader appearing for the 3rd respondent.

6. In view of the limited relief sought for in this Writ Petition, this Court without expressing any opinion on the merits of the case, directs the 3rd respondent to consider the petitioner’s representation dated 07.05.2025 and pass appropriate orders on the same in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties.

7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
