6.Ambiah ...respondents Prayer: Writ Petition is filed under Section 226 of the Constitution of India for issue of Writ of Mandamus, directing the respondents 1 - 4 to forthwith cancel the allotment made for the land in Plot No-20, Door No.21, Villivakkam Road, Lakshmipuram, Chennai 600 099 registered to and in favour of the 5^th and 6^th respondents based on petitioner’s representation dated 26.05.2025 and consequently direct the respondents 1-4 to take appropriate action against the erred officials incharge for the said unlawful allotment, within the time to be stipulated by this Court.

O R D E R

This writ petition is filed for the following relief:

“To direct respondents 1 to 4 to forthwith cancel the allotment made for the land in Plot No-20, Door No.21, Villivakkam Road, Lakshmipuram, Chennai 600 099 registered to and in favour of the 5^th and 6^th respondents based on the petitioner’s representation dated 26.05.2025 and consequently direct the respondents 1 to 4 to take appropriate action against the erred officials incharge for the said unlawful allotment, within the time to be stipulated by this Court.”

2. Alleging that the respondents 5 and 6 had been allotted a land on the basis of bogus documents submitted by them, the petitioner has filed this writ petition seeking to cancel the said allotment.

The petitioner has nowhere in his affidavit given any detail of the alleged bogus documents that had been submitted by respondents 5 and 6 and except for stating that the allotment had been made on the basis of the bogus documents. There are no documents filed to substantiate the said complaint.

The respondents 3 and 4 had filed a counter affidavit, in which it has been stated that the board had conducted a detailed enquiry and the allotment has been made only on perusing the Aadhar card, original allotment order and ration card. These respondents would also submit that the entire sale consideration has also been paid by respondents 5 and 6 on 30.03.2023, itself.

5. These respondents would further submit that to the written complaint made on 31.07.2023 by the petitioner, the board has also sent a reply on 08.09.2023 to the petitioner. Thereafter, an enquiry had been conducted in which the petitioner and the respondents 5 and 6 were present and documents were also produced during the enquiry. Therefore, in the light of the above, the relief claimed by the petitioner cannot be considered.

6. Heard the rival submissions on the either side and perused the records.

7. From a perusal of the records and submissions of the learned counsels on the either side, the complaint appears to be a motivated one and an unsubstantiated one. Therefore, in the absence of any material to buttress the complaint of the petitioner a mandamus cannot be issued to the respondents. That apart, the petitioner’s complaint has already been considered by the respondents. Accordingly, this writ petition is dismissed. No costs.
