Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the second respondent to disburse the arrears of salary due and payable to the petitioner for the period from May 2020 to May 2025, amounting to Rs.43,13,590/- (Rupees Forty Three Lakhs Thirteen Thousand Five Hundred and Ninety Only), together with interest at the rate of 18% per annum from May 2020 till the date of actual disbursement and further, direct the second respondent to remit the outside recovery deductions amounting to Rs.12,42,123/- to the respective third party creditors and pay interest at the rate of 18% per annum on such amount from July 2017 till the date of actual remittance and further, direct the respondents to implement the 7th Pay Commission recommendations with retrospective effect and extend the revised pay benefits to the petitioner.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the second respondent to disburse the arrears of salary due and payable to the petitioner for the period from May 2020 to May 2025, amounting to Rs.43,13,590/- (Rupees Forty Three Lakhs Thirteen Thousand Five Hundred and Ninety Only), together with interest at the rate of 18% per annum from May 2020 till the date of actual disbursement and further, direct the second respondent to remit the outside recovery deductions amounting to Rs.12,42,123/- to the respective third party creditors and pay interest at the rate of 18% per annum on such amount from July 2017 till the date of actual remittance and further, direct the respondents to implement the 7th Pay Commission recommendations with retrospective effect and extend the revised pay benefits to the petitioner.

2.The learned counsel appearing for the petitioner submitted that the petitioner joined the second respondent Board as Draughtsman w.e.f.13.03.1991 and was promoted as Junior Engineer w.e.f.2008. From the financial year 2020 – 2021, the respondent Board completely stopped paying monthly salary to its employees, thereby, the petitioner has filed this writ petition.

3.The learned Additional Government Pleader (P) appearing for the respondents on instructions submitted that the eligible salary of the petitioner will be paid within a period of four months from the date of receipt of a copy of this order.

4.In view of the submission made by the learned Additional Government Pleader (P) appearing for the respondents, this Court directs the respondents to pay the eligible salary of the petitioner, within a period of four months from the date of receipt of a copy of this order.

5.The writ petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
