ORDER
This writ petition has been filed to call for the records of the respondent relating to the order bearing No. TNPCS/ 104/ 2025- ES-1- Part(1) dated 24.09.2025 and quash the same and direct the respondent to forthwith give a suitable posting to the petitioner in Chennai.
2. It is the case of the petitioner that she is a physically challenged person with 60% permanent disability affecting her right leg, resulting in difficulty in walking and climbing. She is presently working as an Assistant in Special Prison Officer (Women) under the respondent.
3. While so, by proceedings dated 29.04.2025, she was transferred to the Special Prison for Women, Tiruchirappalli, allegedly overlooking the guidelines governing transfers of physically disabled persons as well as the norms applicable to the post of Assistants. Aggrieved by the said transfer, the petitioner submitted a representation dated 21.05.2025 seeking posting to any prison within the Chennai Central Prison by taking into account her physical disability. As the said representation was not considered, the petitioner filed W.P.No.29496 of 2025, wherein this Court, by order dated 07.08.2025, directed the respondents to consider and pass orders on the petitioner’s representation dated 21.05.2025. Pursuant thereto, the respondent passed the impugned order dated 24.09.2025 rejecting the petitioner’s request without assigning any valid or cogent reasons. Challenging the said order and seeking a direction to provide a suitable posting in Chennai, the present writ petition has been filed.
4. Learned counsel for the petitioner submitted that the petitioner is a physically challenged woman employee and that the transfer to Tiruchirappalli has caused grave hardship, contrary to the settled transfer guidelines and welfare measures applicable to persons with disabilities. In view of the above, she prayed that the impugned transfer order dated 24.09.2025 has to be quashed and suitable directions have to be issued.
5. Learned Additional Government Pleader appearing for the respondent submitted that subsequent to filing of this writ petition and as per the directions of this Court in the previous hearing, he produced the proceedings issued by the respondent dated 10.01.2026, transferring the petitioner to Central Prison – 2, Chennai in the existing vacancy and therefore, nothing survives for further adjudication. Hence, he prayed that this Court may close this writ petition.
6. On perusal of the copy of the proceedings dated 10.01.2026 issued by the respondent, learned counsel for the petitioner acceded to close this writ petition.
7. Recording the fair submissions and in view of the subsequent development, no further adjudication is required in this writ petition. Accordingly, the writ petition is closed. No costs. Consequently, connected miscellaneous petition is also closed.
