Prayer: This writ petition is filed under Article 226 of the Constitution of India

praying to issue a Writ of Certiorarified Mandamus calling for records relating

to the order of the second respondent made in O.Mu.No.9006/A2/2025 dated

17.11.2025, to quash the same and to consequently direct the respondents to

grant selection grade scale of pay in the post of B.T.Assistant w.e.f. 01.06.2018

and to appropriately revise and refix the pay benefits subsequent thereto till

date.

ORDER

This writ petition is filed to call for the records relating to the order of the

second respondent made in O.Mu.No.9006/A2/2025 dated 17.11.2025, to quash

the same and to consequently direct the respondents to grant selection grade

scale of pay in the post of B.T.Assistant w.e.f. 01.06.2018 and to appropriately

revise and refix the pay benefits subsequent thereto till date.

2. The case of the petitioner is that the petitioner was appointed as

Secondary Grade Teacher in the year 2003 and thereafter, she was posted as

B.T.Assistant (Mathematics) on 02.06.2008 and subsequently, she was posted

as P.G.Assistant (Mathematics) in the year 01.07.2021. However, the first

respondent vide order dated 29.01.2022, rejected the approval of the petitioner’s

appointment as PG Assistant, which was challenged before this Court in

W.P.No.5996 of 2022 and the same was allowed on 16.04.2024 with a direction

to approve the appointment of the petitioner with effect from 01.07.2021 as PG

Assistant (Mathematics) and pay her all attendant of arrears of pay. Pursuant to

the said order, the petitioner’s appointment as PG Assistant was approved.

Since, the petitioner has completed ten years of service, she made a request for

grant of selection grade and the same was rejected by the second respondent

dated 17.11.2025. Challenging the said order, the petitioner has come forward

with the present writ petition.

3. Learned counsel for the petitioner would submit that the petitioner has

completed ten years of service in the post of B.T.Assistant from the year 2008-

2018. Hence, she is entitled for selection grade. In respect of increment, unless

she possess the T.E.T. qualification, she is not entitled to the same. Hence, he

prays this Court that direction may be issued to the respondents to confer the

selection grade in favour of the petitioner and also grant liberty to claim

increment, on completion of T.E.T., qualification.

4. Learned Special Government Pleader appearing for the respondents

would submit that though the petitioner claims that she has completed 10 years

of service, she has acquired promotion to the post of P.G.Assistant. Hence, she

is not entitled to selection grade. Accordingly, she prays for dismissal of this

writ petition.

5. Heard the learned counsel on either side and perused the materials

available on record.

6. The facts in the present case are not in dispute. Admittedly, the

petitioner entered service as Secondary Grade Teacher in the year 2003 with a

qualification of B.Sc., Mathematics. Subsequently, she was appointed as

B.T.Assistant on 02.06.2008. On completion of ten years as B.T.Assistant, she
