PRAYER; This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents to issue selection and appointment order to the petitioner to the post of Physical Education Teacher in accordance with the selection list Called for Certificate Verification dated 2.12.2020 based on the marks secured in the selection under B.C. (WT) Category in the vacancies earmarked for School Education Department followed by other Departments, with all consequential and other attendant benefits in consideration of representation submitted by the petitioner dated

ORDER

This petition has been filed seeking a direction to the respondents to issue selection and appointment order to the petitioner to the post of Physical Education Teacher in accordance with the selection list Called for Certificate Verification dated 2.12.2020 based on the marks secured in the selection under B.C. (WT) Category in the vacancies earmarked for School Education Department followed by other Departments, with all consequential and other attendant benefits in consideration of representation submitted by the petitioner dated 18.01.2024.

It is the case of the petitioner that the petitioner has studied Higher Grade in Physical Education in YMCA, Nandanam, Chennai with medium of instruction Tamil and completed the same in the year 2004. The second respondent issued notification on 26.07.2017 inviting application for direct recruitment for special teachers in School Education and other departments for the year 2012 to 2016. As per notification, 2325 vacancies have been notified. The petitioner has applied for the post of P.ET. Under PSTM category. In the written examination, the petitioner has secured 65 marks including 5 marks awarded for employment seniority and she secured first rank for selection to the post of P.ET. Under PSTM category. The petitioner is a successful candidate and she was called for certificate verification. However, the petitioner's name was not mentioned in the selection order and posting order has been issued to the other candidates. When the petitioner approached the TRB, there is no respondent. Therefore, the petitioner has made a representation to the respondents to consider her claim. The same is not consider. Hence, the petitioner has filed the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider the representation and publish the final list of the candidates within the stipulated time as fixed by this Court.

4. Heard the learned counsel for both side and perused the materials available on record.

5. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the second respondent to publish the final list of the candidates, if not published, within a period of two weeks from the date of receipt of a copy of this order.

6. With the above directions, the writ petition is disposed of. No costs.
